MUSIC CHOICE Files a Lawsuit Against AOL to Prevent the Use of the Trademark "My MC"

HORSHAM, PA -- (MARKET WIRE) -- 05/12/04 -- Music Choice, a premier music television network, today announced the filing of a lawsuit against AOL regarding that company's launch of a competing music service under the confusingly similar name MY MC. Music Choice filed the lawsuit lawsuit in the Superior Court of Pennsylvania on Wednesday, May 12, after efforts to settle the dispute out-of-court failed.

Music Choice, long known to consumers and members of the trade by the acronym "MC," launched a revolutionary new customizable music service under the name My MUSIC CHOICE in November 2003 in a regional market. First announced to the public over a year ago, Music Choice's My MUSIC CHOICE product offers digital cable subscribers the unique opportunity to create custom music channels tailored to their own personal taste. The My MUSIC CHOICE product is scheduled for nationwide launch this summer and has already received significant favorable press coverage.

"While Music Choice welcomes fair competition, we object to a competitor introducing a competing product under a confusingly similar name. With millions of names out there to choose from, AOL's selection of the name MY MC for a channel that may appear alongside our own "MC" branded music channels will undoubtedly lead to confusion among the public and the industry at large," stated David Del Beccaro, President and CEO of Music Choice.
